The Bureau of Industry and Security has issued a reminder that all Simplified Network Application Processing-Redesign (SNAP-R) account holders with at least one active SNAP-R account must designate an administrator by June 9, 2011. After this date, all active SNAP-R user accounts associated to the company CIN without a designated company administrator will become inactive until at least one company administrator is designated. The Bureau of Industry and Security has posted the record of public comments on its December 2010 advance notice of proposed rulemaking (ANPR) seeking comments on how the descriptions of items controlled on the Commerce Control List (CCL) could be more clear, positive, and “tiered,” in a manner consistent with the control criteria the Administration is developing as part of its export control reform effort. The Bureau of Industry and Security has posted the record of public comments on its December 2010 proposed rule to add a new License Exception Strategic Trade Authorization (STA) to allow exports, reexports and transfers (in-country) of specified items to destinations that pose little risk of unauthorized use of those items.
Export.gov has announced that registration is available for a number of upcoming export-based webinars.
The Bureau of Industry and Security announces the annual Update Conference on Export Controls and Policy on July 19-21, 2011 in Washington, DC, which will give the exporting community the opportunity to engage senior government officials about current issues and trends in export control policies, regulations and practices. It also provides the opportunity to network with colleagues in the export control industry and learn about programs and services offered by government and industry exhibitors. Additional information and registration will be available in the late Spring.
The Bureau of Industry and Security requests comments on a proposed voluntary information collection to provide a procedure for persons or organizations listed on the Entity List to request removal or modification of the entry that affects them, which BIS will send to the Office of Management and Budget for approval. Comments are due by May 23, 2011.
Export.gov has announced a series of trade missions that are scheduled for the remainder of March through June 2011.
The Bureau of Industry and Security announces that ArvinMeritor of Troy, Michigan, has agreed to pay a $100,000 civil fine to settle allegations that it committed 14 violations of the Export Administration Regulations. In 2005-2006, ArvinMeritor shipped products, including various vehicle axles and seal assemblies controlled for national security reasons, to China and France; and exported technical data, controlled for national security reasons, to Italy, India, China, Mexico, South Korea, and Brazil. ArvinMeritor voluntarily disclosed the violations, which BIS states is considered a “great weight” mitigating factor in the settlement of BIS administrative cases.
The Bureau of Industry and Security's Regulations and Procedures Technical Advisory Committee (RPTAC) held a partially open meeting on March 15, 2011 to discuss updates to proposed export control reform regulations, including a rulemaking on license exception STA.
The State Department has issued a proposed rule to amend the International Traffic in Arms Regulations (ITAR) to add a licensing exemption for the temporary export of chemical agent protective gear covered by the U.S. Munitions List (USML)1 for exclusive personal use to destinations not subject to restrictions under 22 CFR 126.12, and to Afghanistan and Iraq under specified conditions, etc.
