Search Primer

Multi-word term: Place inside quotes to ensure an exact match together (e.g. "China import").

Term list: Separate terms with spaces, not commas or semicolons to find either word (e.g. AD/CVD antidumping).

Acronyms: Use all capital letters (e.g., ACE).

Required term: If a term must be included in any resulting articles, prefix it with a plus sign (e.g., CBP +releases).

Excluded term: If a term should be excluded from any articles being found, prefix it with a minus sign (e.g., -ruling).

Singular form: Use the singular form when doing multi-word terms (e.g. "russian export control" instead of "russian export controls").

Shortest word form: When you have different word forms in a quoted term, include the shortest version if it is the last part of the expression (e.g., "entity list" instead of "entity listing" or "entity listed").

FDA Posts Guidance on Declaring Nutrients in Small Amounts on Nutrition Labeling

The Food and Drug Administration issued new guidance (here) for manufacturers of food and dietary supplements outlining agency policy on declaring small amounts of certain nutrients and dietary ingredients on nutrition labels. The document clarifies when FDA will use its enforcement discretion in cases in which a conflict may occur between FDA regulations on how to declare certain nutrients and dietary ingredients when present in small amounts.

FDA Proposes Regulations on Entry Filing in ACE, Seeks Comments

The Food and Drug Administration is proposing to codify its procedures for electronic filing of entries of FDA-regulated products in ACE. The agency’s proposed rule (here) would add new sections to the FDA regulations specifying the data elements that must or may be filed in ACE at the time of entry, and make “technical revisions” to existing FDA regulations, including an alignment of the FDA definition of owner or consignee with CBP’s definition. Comments on the proposed rule are due Aug. 30. In addition to general comments, FDA is also seeking specific input on a variety of ACE requirements FDA is proposing to codify in its regulations, including the following:

FDA Seeks Comments on Petition To Ban Potassium Perchlorate in Food Containers

The Food and Drug Administration is seeking comments on a petition to no longer allow for the use of potassium perchlorate as an additive in closure-sealing gaskets for food containers (here). The Society of the Plastics Industry submitted the petition, purporting that the substance is no longer put to that use, the FDA said. Comments on whether potassium perchlorate is still used by industry in closure-sealing gaskets for food containers, and should therefore still be allowed as an additive, are due Aug. 29.
