The International Trade Commission has begun a formal Section 337 investigation on video processing devices imported by HP, according to a notice released Nov. 28 (ITC Inv. No. 337-TA-1341). An Oct. 19 complaint by VideoLabs alleged that HP has imported desktop and laptop computers that are capable of encoding video data using context-adaptive variable-length coding, of demultiplexing data into coded audio data and coded video data, or contain integrated circuits that are capable of the same. VideoLabs said that these items infringe three of its patents concerning apparatus for more efficient encoding and decoding of video with compression techniques and has asked the ITC for permanent limited exclusion and cease and desist orders against the infringing products.
The Commerce Department has issued its final determination in the antidumping duty investigation on preserved mushrooms from France (A-427-833). Changes to cash deposit requirements set in these final determinations take effect Nov. 28, the date they were published in the Federal Register.
Sen. Mark Warner, D-Va., one of the primary movers behind the Chips Act, told an audience that more domains need policymakers' attention so that they don't wake up to find that China has become dominant in an important emerging technology. He noted that before becoming a politician, he "was in the telecommunication space," and said that realizing that China is dominating 5G with two heavily subsidized champion companies was the "final wake-up call" that engagement and deeper trade with China is not the right way to go.

The Information Technology and Innovation Foundation says the Section 301 tariffs on Chinese imports have been fruitless, and antidumping and countervailing duty laws also are inadequate to counter the wide variety of abuses from China -- industrial espionage, forced technology transfer, discrimination against foreign sales in China, as well as enormous subsidies. "It is time for the U.S. government, ideally working with allies, to craft and implement a new set of trade defense instruments," ITIF Founder Robert Atkinson wrote in a white paper released Nov. 21.

The Commerce Department Nov. 18 released antidumping duty orders on oil country tubular goods from Argentina, Mexico and Russia (A-357-824, A-201-856, A-821-833), and countervailing duty orders on oil country tubular goods from South Korea and Russia (C-580-913, C-821-834). The orders set permanent antidumping and countervailing duties, which will remain in place unless revoked by Commerce in a sunset or changed circumstances review. Commerce will now begin conducting annual administrative reviews, if requested, to determine final assessments of AD/CVD on importers and make changes to cash deposit rates.
