321 de minimis

De minimis is a policy described in 19 U.S.C. 1321 that allows the import of low value articles duty and tax free, provided their aggregate fair retail value does not exceed $800 in the country from which the articles are imported.  Additionally, the articles must be imported by only one person on one day. The previous de minimis threshold was $200, but the Trade Facilitation and Trade Enforcement Act of 2015 increased it to $800. Increasing volumes of de minimis merchandise, along with enforcement concerns related to fentanyl and counterfeit merchandise, among other things, have prompted calls to restrict the pathway. De minimis goods may be cleared off manifest, or qualifying goods may be entered under the informal Type 86 entry type.

CIT Rules Canada Lumber with an Angle Cut is HTS 4407 Sawn Wood

In Canex International Lumber Sales Ltd., v. U.S., the Court of International Trade ruled that cut lumber, with an angle cut on one end and a square cut on the other end was properly classified as sawn wood under Harmonized Tariff Schedule (HTS) 4407.10.0015 free of duty, and not as roof trusses under 4418.90.4020 at 3.2% ad valorem, or as other articles of wood under 4421.90.9840 at 3.3% ad valorem.

Global Engineering Firm Agrees to Pay $240 Million FCPA Criminal Penalty

The Justice Department has announced that Technip S.A., a global engineering, construction and services company based in Paris, has agreed to pay a $240 million criminal penalty to resolve charges related to the Foreign Corrupt Practices Act for its participation in a decade-long scheme to bribe Nigerian government officials to obtain engineering, procurement and construction (EPC) contracts. The EPC contracts to build liquefied natural gas (LNG) facilities on Bonny Island, Nigeria, were valued at more than $6 billion.
