The Senate will likely confirm Tom Feddo as a top official for the Committee on Foreign Investment in the U.S., a “positive and timely development” for companies involved in foreign investment compliance, according to an Aug. 19 post from Arent Fox. Feddo is expected to be named the first assistant secretary of the Treasury for investment security. The position was created in 2018 to increase the authority of CFIUS when it enacted the Foreign Investment Risk Review Modernization Act, the post said.
In preparation for a public hearing on China's compliance with its World Trade Organization commitments, the Office of the U.S. Trade Representative is seeking comments at regulations,gov, docket number is USTR-2019-0010. Comments and requests to testify are due by midnight EDT Sept. 18, The hearing will be held Oct. 2 by the interagency Trade Policy Staff Committee at 1724 F Street NW, Washington, D.C., beginning at 9:30 a.m.
The Office of the U.S. Trade Representative is seeking comments to inform its annual congressional report on Russia’s implementation of obligations as a member of the World Trade Organization, the USTR said in a notice the Aug. 14 Federal Register. The interagency Trade Policy Staff Committee, chaired by the USTR, will hold a public hearing on Oct. 8. Written comments and requests to speak at the hearing are due Sept. 27.
The Commerce Department’s Bureau of Industry and Security made several changes to its Entity List, adding, removing and modifying entries for companies in China, Canada, Malaysia, Russia, The United Kingdom, the United Arab Emirates and more. The changes add 17 entities to the list, modify 23 existing entries for China, Hong Kong and Russia, and remove three entities located in China and the UAE, BIS said in a notice. The changes take effect Aug. 14.
The Treasury Department’s most recent Venezuela-related general licenses “stop just short of a total embargo” on the country’s government, said Adrienne Braumiller, a trade lawyer and member of the Commerce Department’s Regulations and Procedures Technical Advisory Committee. Some companies will need to pay close attention to the updated expiration dates for certain general licenses, she said, and banks will be faced with a “new level of depth” to the complexity of screening their customers.
Republican senators urged the European Union to increase sanctions on the Nicolas Maduro-led regime in Venezuela, saying in a letter the EU should “align its sanctions regime” with that of the U.S. and Canada, according to an Aug. 8 Senate Foreign Relations Committee press release. The senators said the U.S. and Canada have imposed sanctions on more than 200 Venezuelan government officials, and the EU’s support would “send a powerful message” to Maduro.
The Commercial Customs Operations Advisory Committee appears to be among the advisory committees that aren't eligible for elimination under a recent executive order. President Donald Trump issued an executive order in June that directed all federal departments and agencies to eliminate one-third of their current Federal Advisory Committee Act-authorized committees by Sept. 30 (see 1906170021). Committees authorized by statute aren't eligible for elimination and, according to a search on the FACA database, there are 22 trade-focused committees that are required by statute.
Senate Finance Committee Chairman Chuck Grassley, R-Iowa, raised the possibility that he would not be able to broker a compromise between the two approaches on restraining the president's ability to levy tariffs under Section 232. While he said his goal is to have a committee meeting in late September or early October that would take up a "Grassley-Wyden" version, he said if that can't happen, he will bring forward competing bills and allow lots of amendments to shape them.
CBP issued a notice in the Aug. 7 Customs Bulletin (Vol. 52, No. 27) regarding the dates and draft agenda for the 64th Session of the World Customs Organization’s Harmonized System Committee (HSC), which will meet in Brussels Sept. 18-27. Among other things, the HSC issues classification decisions on the interpretation of the Harmonized System (HS) in the form of published tariff classification opinions or amendments to the Explanatory Notes. It also considers amendments to the legal text of the HS.
