The Enforce and Protect Act evasion investigation process is being gamed by both allegers and CBP to tilt it in favor of finding evasion by importers to the point that the agency finds evasion 90% of the time, customs lawyers Jennifer Diaz and David Craven said during a June 29 webinar hosted by National Customs Brokers & Forwarders Association of America Educational Institute.

CBP found reasonable suspicion that 14 importers evaded antidumping duty orders on thermal paper from Germany and South Korea, and initiated an Enforce and Protect Act investigation and imposed interim measures, according to a Jan. 24 notice.
The Treasury Department published its fall 2022 regulatory agenda for CBP. The only new mention of any regulations is a new long-term action that would amend CBP's regulations "pertaining to prior disclosure and to the procedure for demanding payment of duties, taxes, fees, or revenue" when a penalty claim isn't issued. "Amendments are designed to encourage participation in the prior disclosure program and to enhance the effectiveness of the duty/revenue demand process," the agenda said.

The Department of Commerce preliminarily determined that certain types of truck wheels that Asia Wheel manufactures in its facilities in Thailand and exports to the U.S. are subject to the antidumping and countervailing duty orders on certain steel wheels 22.5 to 24.5 inches in diameter from China, according to a Dec. 13 preliminary scope ruling.
