CBP created Harmonized System Update (HSU) 1902 on Feb. 26, containing 40 Automated Broker Interface records and 11 harmonized tariff records, it said in a CSMS message. The update includes changes related to the delayed increase to Section 301 tariffs on goods from China. "Changes were made to extend the 10 percent duty rate" on Harmonized Tariff Schedule subheading 9903.88.03, the agency said. "This will allow for pre filing of entries at the 10 percent duty rate. Further updates are possible after the forthcoming Federal Register notice is published."

The update includes changes mandated by Presidential Proclamation 9834 (see 1812270038), as well as adjustments required by the Office of the U.S. Trade Representative's announcement of new exemptions from Section 301 tariffs on China (see 1902110018). Modifications required by the verification of the 2019 Harmonized Tariff Schedule (HTS) are included as well.
Cecilia Malmstrom, the European Union's trade commissioner, told an audience at the Atlantic Council Jan. 10 that if U.S. tariffs on imported autos were to be implemented, the EU would not accept a quota system as Canada and Mexico have done. Malmstrom has been in Washington meeting with U.S. Trade Representative Robert Lighthizer this week on both World Trade Organization reform and the bilateral trade relationship.
The ongoing partial federal government shutdown is causing some confusion for the trade community on tariff classification. CBP’s last tariff update in the Automated Broker Interface came on Dec. 19 (see 1812190004), but the International Trade Commission has not yet issued its annual update to the online Harmonized Tariff Schedule (see 1901020021). Further complicating matters, a presidential proclamation making more changes to the HTS is now set for publication on Jan. 7 (see 1812270038).

Lawmakers were unable to reach a federal government funding deal on Dec. 21, resulting in a shutdown that began at 12:01 a.m. on Dec. 22 and has no clear end in sight. CBP held a conference call on Dec. 21 with members of the trade to discuss the agency's operations during a shutdown, according to the National Customs Brokers & Forwarders Association of America. CBP will have conference calls during the shutdown and is preparing a CSMS message to detail its plans, the NCBFAA said.

The update includes changes related to the delayed increase of Section 301 tariffs on goods from China (see 1812180010), CBP said. Other changes "include the annual special program staged rate reductions mandated by the individual Free Trade Agreements," it said. "This update also contains modifications mandated by the 484 F Committee, the Committee for Statistical Annotation of Tariff Schedules. These adjustments are effective on January 1, 2019 and will be published within the change record, and chapters, of the 2019" Harmonized Tariff Schedule of the United States.
