Trade negotiations have to adjust as Internet-enabled communication technologies develop, said Deputy Assistant U.S. Trade Representative for Telecommunications and Electronic Commerce Policy Jonathan McHale Monday. Speaking at an event hosted by the Federal Communications Bar Association, McHale said the USTR is beginning to approach trade negotiations through the lens of emerging technology and is considering restarting World Trade Organization (WTO) negotiations with the same perspective.

It also said the continent would generate an extra $20 billion in yearly earnings if African leaders could dismantle trade barriers.
The Federal Trade Commission scheduled a Nov. 29 forum on enforceable industry codes of conduct to protect consumers in cross-border commerce. It said such voluntary procedures developed by government entities, businesses, consumer groups and other organizations are becoming increasingly important with the expansion of global commerce. The forum will explore the use of systems like one created earlier this year to give consumers in the Asia-Pacific region more consistent privacy protections when their information moves between countries with different privacy rules, the FTC said. The open forum will be at the FTC's Satellite Building Conference Center in Washington, D.C., and will precede a conference sponsored by the American Society of International Law Nov. 29 to Dec. 1 at the George Washington University Law School on the role of the private sector in shaping oversight of the global marketplace.

Monsanto may substitute one type of chemical for the export of another type, said CBP's Entry Process and Duty Refunds Branch in an Aug. 17 ruling recently added to CBP's CROSS database. CBP said it considered the two products commercially interchangeable and eligible for unused merchandise drawback despite different levels of the active ingredient and different tariff classifications. Specifically, CBP found the chemicals met the criteria for being interchangeable under the drawback statute, 19 U.S.C. Section 1313(j)(2).
