ITC Begins Section 337 Investigation on Imported Medical Admixture Devices
The International Trade Commission is beginning a Section 337 investigation on imported medical admixture devices (ITC Inv. No. 337-TA-1362). The items at issue are fluid transfer devices that have a trifurcated connector body with an integral vial adapter.

The investigation follows an April 4 complaint by West Pharmaceutical Services of Pennsylvania and West Pharma of Israel, alleging that "opportunist companies" Advcare Medical in Taiwan, Dragon Heart Medical in China and Summit International Technologies in Massachusetts have introduced copycat devices that infringe on four patents and a trademark owned by the complainants.
West asked the ITC for a permanent limited exclusion order blocking entry of all liquid transfer devices that infringe on at least one of the asserted patents or the asserted trademark as well as cease and desist orders against the proposed respondents.
