ITC Asks for Comments on Possible Section 337 Probe of Imported Vaping Devices
Comments are due to the International Trade Commission by July 17 concerning a possible Section 337 investigation on imported electronic nicotine delivery systems, or vaporizers, according to a Federal Register notice (ITC Docket No. 3685).

The call for comments followed a June 30 complaint by Juul Labs and VMR Products, which alleged that Altria and NJoy have imported vaporizer cartridges and components that infringe on five patents owned by Juul. Juul and VMR asked the ITC for a permanent limited exclusion order preventing entry of vaporizes, cartridges, and other components of components of electronic nicotine delivery systems as well as cease and desist orders.
