CBP ignored Congress' "unambiguous express statutory command when it failed to distribute" interest assessed after liquidation, known as delinquency interest, under the Continued Dumping and Subsidy Offset Act of 2000, appellant Monterey Mushrooms said in a reply brief at the U.S. Court of Appeals for the Federal Circuit (Adee Honey Farms, et al. v. United States, Fed. Cir. # 22-2105).

CBP's decision not to pay out interest assessed after liquidation, known as delinquency interest, on collected antidumping and countervailing duties violates the plain language of the Continued Dumping and Subsidy Offset Act of 2000, groups of plaintiff-appellants argued in two opening briefs in two different cases at the U.S. Court of Appeals for the Federal Circuit. One brief, penned by appellants led by Hilex Poly Co. and American Drew, said that even if the law was ambiguous, CBP has failed to exercise any authority "in a way that deserves deference" (Hilex Poly Co. v. United States, Fed. Cir. #22-2106) (Adee Honey Farms v. United States, Fed. Cir. #22-2105).
Commerce Secretary Gina Raimondo told senators that the preliminary finding that antidumping and countervailing duties ought to roughly double on imported Canadian software lumber "couldn’t have come at a worse time," since she has been hearing from stakeholders consistently that the surge in the price of lumber is hurting builders and consumers. Raimondo, who was testifying at a May 26 hearing before a Senate Appropriations subcommittee that covers her agency, was first asked about the issue by ranking member Sen. Jerry Moran, R-Kan.

The agency will impose AD duty cash requirements on entries of subject merchandise beginning on Nov. 22, except for some companies from Italy, South Korea and China, for which cash deposit requirements retroactively begin Aug. 24.
