The Court of International Trade again remanded the Commerce Department's decision to continue using adverse facts available against countervailing duty respondent The Ancientree Cabinet Co. related to its alleged receipt of benefits under China's Export Buyer's Credit Program. In a July 22 decision made public July 30, Judge Richard Eaton instructed the agency to "determine a customer-specific rate that excludes" the EBCP subsidy amount for Ancientree's U.S buyers "whose non-use" of the program was verified.

The Commerce Department issued its final determinations in the antidumping duty investigations on mattresses from India (A-533-919), Kosovo (A-803-001), Mexico (A-201-859) and Spain (A-469-826). Cash deposit rates set in these final determinations take effect July 22.
The Commerce Department issued antidumping duty orders on paper shopping bags from Cambodia (A-555-002), China (A-570-152), Colombia (A-301-805), India (A-533-917), Malaysia (A-557-825), Portugal (A-471-808), Taiwan (A-583-872) and Vietnam (A-552-836), and countervailing duty orders on paper shopping bags from China (C-570-153) and India (C-533-918).
The Commerce Department issued notices in the Federal Register on its recently initiated antidumping and countervailing duty investigations on brake drums from China and Turkey (A-570-174/C-570-175, A-489-853/C-489-854). The CVD investigations cover entries for the calendar year 2023. The AD investigation on Turkey covers entries April 1, 2023, through March 31, 2024, and the AD investigation on China covers entries Oct. 1, 2023, through March 31, 2024.
The Commerce Department will conclude its countervailing duty investigation on mattresses from Indonesia without imposing a CVD order, it said in a fact sheet announcing its final negative determination in the CVD investigation, as well as affirmative antidumping duty investigations for four other countries. For those other four countries, the agency amended some AD rates from its preliminary determinations, setting them at 13.35% to 42.76% for India, 63.66% to 344.7% for Kosovo, 37.59% to 61.97% for Mexico and 4.61% to 280.28% for Spain. The amended rates will be effective upon publication of these final determinations in the Federal Register in the coming days. Commerce issued AD orders for mattresses from eight other countries on July 11 (see 2407160012).

Judges at the U.S. Court of Appeals for the Federal Circuit during a July 11 oral argument probed the government and parties to an antidumping and countervailing duty scope case on its standard of review in the scope case. Judge Sharon Prost said at the outset that the court is "being very careful" in terms of what it says on standard of review issues in "light of all of the recent opinions and litigation concerning standard of review" in administrative law issues (Worldwide Door Components v. United States, Fed. Cir. # 23-1532).
