The European Union is setting preliminary countervailing duties on Chinese electric vehicles beginning on July 5, as expected (see 2406120008), the European Commission said. The rates are slightly lower than rates announced in early June, prior to negotiations between Chinese and EU officials that will still continue despite the imposition of CV duties. Revised CVD rates are 17.4% for BYD, 19.9% for Geely, 37.6% for SAIC, 20.8% for Chinese companies that cooperated but weren't individually investigated, and 37.6% for non-cooperating companies. Tesla, at its request, may receive its own individual rate in the EU's final determination, the European Commission said.

The Commerce Department began administrative reviews for certain firms subject to antidumping and countervailing duty orders with May anniversary dates. Producers and exporters subject to any of these administrative reviews on China or Vietnam must submit their separate rate certifications or applications on or about Aug. 5 to avoid being assigned high China-wide or Vietnam-wide rates.
The Commerce Department has released its final determination in the antidumping duty investigation on pea protein from China (A-570-154). Cash deposit rates set in this final determination take effect July 5.

The Commerce Department issued notices in the Federal Register on its recently initiated antidumping and countervailing duty investigations on vanillin from China (A-570-172/C-570-173). The CVD investigation covers entries Jan. 1 - Dec. 31, 2023. The AD investigation covers entries Oct. 1, 2023 - March 31, 2024.
The Commerce Department wrongly countervailed benefits received by a Turkish rebar exporter under a law the department hadn’t known existed until the exporter noted it in a filing -- while rejecting that filing, said exporter claimed in a June 27 complaint (Kaptan Demir Celik Endustrisi ve Ticaret v. U.S., CIT #24-00096).

The U.S. Court of Appeals for the Federal Circuit on June 21 sustained the Commerce Department's final affirmative determination in a countervailing duty investigation on utility scale wind towers from Canada, in which respondent Marmen Energy received a 1.18% CVD rate. Judges Alan Lourie, Sharon Prost and Jimmie Reyna said that because errors were identified in Marmen's year-end exchange rate adjustment to the sales denominator, Commerce appropriately refused to use Marmen's adjustment. The court also held that Commerce adequately countervailed three different subsidy programs.
The Court of International Trade on June 20 said that the Commerce Department's amended antidumping duty finding, excluding Turkish exporter Colakoglu from the AD order on hot-rolled steel from Turkey, doesn't invalidate the International Trade Commission's five-year sunset review of the order.
