Section 301 tariff exclusions

The Office of the U.S. Trade Representative has established an exclusion process for Section 301 tariffs on China. In a series of rounds since the tariffs took effect, importers have been able to request exclusions from the tariffs, as well as extensions to existing exclusions. Many exclusions have been allowed to expire, as well. Section 301 exclusions are applicable to all importers of a given good, which may be defined as an entire tariff schedule subheading or a subset of a subheading outlined in a written description.

Clear Terms

Search Primer

Multi-word term: Place inside quotes to ensure an exact match together (e.g. "China import").

Term list: Separate terms with spaces, not commas or semicolons to find either word (e.g. AD/CVD antidumping).

Acronyms: Use all capital letters (e.g., ACE).

Required term: If a term must be included in any resulting articles, prefix it with a plus sign (e.g., CBP +releases).

Excluded term: If a term should be excluded from any articles being found, prefix it with a minus sign (e.g., -ruling).

Singular form: Use the singular form when doing multi-word terms (e.g. "russian export control" instead of "russian export controls").

Shortest word form: When you have different word forms in a quoted term, include the shortest version if it is the last part of the expression (e.g., "entity list" instead of "entity listing" or "entity listed").

BIS Sends Section 232 Rule for Interagency Review

The Bureau of Industry and Security sent a final rule for interagency review that could make changes to the exclusion process for Section 232 steel and aluminum tariffs. BIS sent the rule to the Office of Information and Regulatory Affairs Feb. 15, about six months after it published proposed changes aimed at improving the accuracy and efficiency of exclusion requests and objections (see 2308250035).

The House Energy and Commerce Subcommittee on Communications and Technology held a legislative hearing Feb. 15 to advance several pending measures, including a bill that would add Chinese drone company Da-Jiang Innovations (DJI) to the Federal Communications Commission’s (FCC) Covered list, which would prohibit DJI technology from operating on U.S. communications infrastructure.
