Section 301 tariff exclusions

The Office of the U.S. Trade Representative has established an exclusion process for Section 301 tariffs on China. In a series of rounds since the tariffs took effect, importers have been able to request exclusions from the tariffs, as well as extensions to existing exclusions. Many exclusions have been allowed to expire, as well. Section 301 exclusions are applicable to all importers of a given good, which may be defined as an entire tariff schedule subheading or a subset of a subheading outlined in a written description.

Search Primer

Multi-word term: Place inside quotes to ensure an exact match together (e.g. "China import").

Term list: Separate terms with spaces, not commas or semicolons to find either word (e.g. AD/CVD antidumping).

Acronyms: Use all capital letters (e.g., ACE).

India Finished Steel Flanges: Final Results of CVD Admin Review

The Commerce Department published the final results of its countervailing duty administrative review on finished carbon steel flanges from India (C-533-872). It said it made no changes to its preliminary results, and set new CV duty cash deposit rates for 38 exporters. These final results will be used to set final assessments of CV duties on importers for subject merchandise entered Jan. 1, 2021, through Dec. 31, 2021.

EPA Allows More Time for Electronic TSCA Polymer Exemption Reports

EPA will give importers and manufacturers additional time to submit reports on polymers manufactured under an exemption from the Toxic Substances Control Act. The agency is extending the deadline to March 31, after technical difficulties affected a switch to electronic submission procedures, giving importers and manufacturers only days to submit reports prior to the original Jan. 31 deadline. The extension will “allow manufacturers additional time to submit their reports and accompanying claims to EPA using the electronic reporting tool,” the agency said.

BIS Sends Section 232 Rule for Interagency Review

The Bureau of Industry and Security sent a final rule for interagency review that could make changes to the exclusion process for Section 232 steel and aluminum tariffs. BIS sent the rule to the Office of Information and Regulatory Affairs Feb. 15, about six months after it published proposed changes aimed at improving the accuracy and efficiency of exclusion requests and objections (see 2308250035).

The Bureau of Industry and Security is making progress on an Information and Communication Technology Services (ICTS) supply chain rule involving “connected vehicles.” The agency sent the prerule for interagency review on Feb. 16.

House Panel Advances Bill to Place DJI on FCC Covered List

The House Energy and Commerce Subcommittee on Communications and Technology held a legislative hearing Feb. 15 to advance several pending measures, including a bill that would add Chinese drone company Da-Jiang Innovations (DJI) to the Federal Communications Commission’s (FCC) Covered list, which would prohibit DJI technology from operating on U.S. communications infrastructure.
