Section 301 tariff exclusions

The Office of the U.S. Trade Representative has established an exclusion process for Section 301 tariffs on China. In a series of rounds since the tariffs took effect, importers have been able to request exclusions from the tariffs, as well as extensions to existing exclusions. Many exclusions have been allowed to expire, as well. Section 301 exclusions are applicable to all importers of a given good, which may be defined as an entire tariff schedule subheading or a subset of a subheading outlined in a written description.

Clear Terms

Search Primer

Multi-word term: Place inside quotes to ensure an exact match together (e.g. "China import").

Term list: Separate terms with spaces, not commas or semicolons to find either word (e.g. AD/CVD antidumping).

Acronyms: Use all capital letters (e.g., ACE).

Required term: If a term must be included in any resulting articles, prefix it with a plus sign (e.g., CBP +releases).

Excluded term: If a term should be excluded from any articles being found, prefix it with a minus sign (e.g., -ruling).

Singular form: Use the singular form when doing multi-word terms (e.g. "russian export control" instead of "russian export controls").

Shortest word form: When you have different word forms in a quoted term, include the shortest version if it is the last part of the expression (e.g., "entity list" instead of "entity listing" or "entity listed").

New and Revised FDA Import Alerts for Nov. 4

On Nov. 4, the FDA posted new and revised versions of the following Import Alerts (after not having posted new ones for a number of days) on the detention without physical examination of:

APHIS Intends to Allow Imports of Orchid Plants From Germany and the Netherlands

The Animal and Plant Health Inspection Service intends to allow imports of Phalaenopsis spp. orchid plants from Germany and the Netherlands in approved growing media into the U.S., it said in a notice. "To be eligible for importation, plants for planting in approved growing media must be of approved plant taxa and come from a facility that is part of an approved growing media program approved by APHIS," the agency said. Such a program deploys measures described by APHIS in the notice to mitigate the risk of pest introduction. If APHIS finalizes the decision, it will allow imports of Phalaenopsis spp. orchid plants from the two countries into the U.S., subject to the phytosanitary requirements specified by the agency. Comments will be accepted through Jan. 6.
