Section 301 tariff exclusions

The Office of the U.S. Trade Representative has established an exclusion process for Section 301 tariffs on China. In a series of rounds since the tariffs took effect, importers have been able to request exclusions from the tariffs, as well as extensions to existing exclusions. Many exclusions have been allowed to expire, as well. Section 301 exclusions are applicable to all importers of a given good, which may be defined as an entire tariff schedule subheading or a subset of a subheading outlined in a written description.

Search Primer

Multi-word term: Place inside quotes to ensure an exact match together (e.g. "China import").

Term list: Separate terms with spaces, not commas or semicolons to find either word (e.g. AD/CVD antidumping).

Acronyms: Use all capital letters (e.g., ACE).

Required term: If a term must be included in any resulting articles, prefix it with a plus sign (e.g., CBP +releases).

Excluded term: If a term should be excluded from any articles being found, prefix it with a minus sign (e.g., -ruling).

Singular form: Use the singular form when doing multi-word terms (e.g. "russian export control" instead of "russian export controls").

APHIS Gives Green Light to Fresh Soursop Fruit Imports From Mexico

USDA's Animal and Plant Health Inspection Service is allowing, effective Oct. 29, fresh soursop fruit from Mexico, it said in a notice. Soursop fruit (Annona muricata) is also known as guanabana. "Based on findings of a pest risk analysis, which we made available to the public for review and comment through a previous notice, we have determined that the application of one or more designated phytosanitary measures will be sufficient to mitigate the risks of introducing or disseminating plant pests or noxious weeds via the importation of fresh soursop fruit from Mexico," APHIS said.

Indigenous Representatives Sought for Volunteer Trade Post

The Office of the U.S. Trade Representative is seeking applications from Native Americans, Native Hawaiians and Native Alaskans who want to serve as an indigenous peoples' representative on the observer delegation to the Partnership Council of the Indigenous Peoples Economic and Trade Cooperation Arrangement. Applications for the two-year terms are due by Dec. 6 at 5 p.m. EST. Applications should be sent to mbx.ustr.iape@ustr.eop.gov.

CIT Says Commerce Has Authority to Countervail Currency Undervaluation

The Commerce Department has the authority to countervail currency undervaluation, the Court of International Trade held in a decision made public Oct. 25. Judge Timothy Reif found that nothing in the text of the countervailing duty statute, the statute's legislative history or legislative or administrative developments prohibit Commerce from imposing CVD due to a country's undervalued currency.
