The Court of International Trade should affirm the Commerce Department's remand results in order to allow a countervailing duty petitioner to potentially appeal aspects of those results to the U.S. Court of Appeals for the Federal Circuit, petitioner Daikin America said in its March 9 remand comments to the Court of International Trade (Gujarat Fluorochemicals Ltd. v. United States, CIT # 22-00120).
The Commerce Department's subsidy calculation errors in a countervailing duty review on multilayered wood flooring from China resulted in an inaccurate CVD rate for Fine Furniture and other Chinese wood flooring exporters, Fine Furniture argued in a March 9 motion for judgment af the Court of International Trade (Baroque Timber Industries (Zhongshan) Co. v. United States, CIT # 22-00210).
The Court of International Trade erred in finding that importer Rimco was required to raise its claims that antidumping and countervailing duty rates violated the U.S. Constitution's Eighth Amendment regarding excessive fines before the Commerce Department administratively, Rimco told the U.S. Court of Appeals for the Federal Circuit in a March 8 reply brief (Rimco v. United States, Fed. Cir. # 22-2079).
The Court of International Trade should again remand the results of a countervailing duty investigation on carbon and alloy steel cut-to-length plate from South Korea to address allegations the Korean government provided off-peak electricity for less-than-adequate-remuneration, Nucor argued March 2 at the Court of International Trade. It also argued Commerce should reconsider whether to treat POSCO's affiliate, POSCO Plantec, as a cross-owned input supplier (Nucor v. U.S., CIT # 21-00182).
The Commerce Department issued the preliminary results of its antidumping and countervailing duty administrative reviews on wood mouldings and millwork from China (A-570-117/C-570-118). In the final results of these reviews, Commerce will set AD assessment rates for subject merchandise for the companies under review entered Aug. 12, 2020, through Jan. 31, 2022, and CVD assessment rates for entries June 12, 2020, through Dec. 31, 2021.
The Commerce Department has released the final results of the antidumping duty administrative review on stainless steel flanges from India (A-533-877). These final results will be used to set final assessments of AD duties on importers for subject merchandise from 23 companies under review entered Oct. 1, 2020, through Sept. 30, 2021.
The Commerce Department on March 6 released a countervailing duty order on barium chloride from India (C-533-909). The order sets permanent countervailing duties, which will remain in place unless revoked by Commerce in a sunset or changed circumstances review. Commerce will begin conducting annual administrative reviews, if requested, to determine final assessments of CVD on importers and make changes to cash deposit rates.
The Commerce Department failed in its obligation to calculate an accurate rate for a Kazakh exporter in a countervailing duty investigation when it unjustifiably rejected the exporter's questionnaire response, despite the response being only two hours late, the exporter, Tau-Ken Temir, said in the opening brief of its appeal at the U.S. Court of Appeals for the Federal Circuit (Tau-Ken Temir v. United States, Fed. Cir. # 22-2204).
The Commerce Department in Feb. 23 remand results reversed course "under respectful protest" on a 26.5% subsidy rate it calculated for land provision by Indian national authorities in its countervailing duty investigation on granular polytetrafluorethylene resin from India (Gujarat Fluorochemicals Ltd. v. U.S., CIT # 22-00120).
The Commerce Department is issuing antidumping and countervailing duty orders on sodium nitrite from India (A-533-906/C-533-907). The orders, scheduled for publication in the Federal Register Feb. 27, set permanent antidumping and countervailing duties, which will remain in place unless revoked by Commerce in a sunset or changed circumstances review. Commerce will now begin conducting annual administrative reviews, if requested, to determine final assessments of AD/CVD on importers and make changes to cash deposit rates.
